Agreement to Terms

By accessing or using Presto ("the Service," "we," "our," or "us"), a product of GrowthClan Inc., you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use the Service.

What Presto Is

Presto is a free service that notifies you when tickets for concerts and events by the artists you follow are expected to go on sale (presales and general on-sale), and provides links to where those tickets may be purchased.

  • Presto is not a ticket seller, reseller, or marketplace. We do not sell tickets and we do not process any payments.
  • We are not affiliated with, endorsed by, or sponsored by Ticketmaster, any venue, promoter, or artist. Their names and marks are used only to identify events.
  • Alerts and sale information are provided for your convenience and may be inaccurate, incomplete, or change without notice.

Eligibility

You must be at least 16 years old to use Presto. By using the Service, you represent and warrant that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into these Terms
  • Your use complies with all applicable laws and regulations

Account Registration

Creating an Account

Some features require an account, created by providing:

  • A valid email address
  • A secure password

Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We are not liable for losses caused by unauthorized use of your account.

Free Service

Presto is currently provided free of charge. There is nothing to purchase from us, and we do not collect payment information.

  • We may introduce optional paid features in the future; if we do, we will present clear terms before any charge applies.
  • We may change, suspend, or discontinue any part of the Service at any time without liability.

Affiliate Links and Third-Party Tickets

  • Presto provides links to third-party platforms (such as official ticket vendors) where tickets may be purchased. All purchases take place on those third-party websites, under their own terms and privacy policies.
  • Some outbound links may be affiliate links, meaning GrowthClan Inc. may earn a commission if you make a purchase through them, at no additional cost to you. This never influences which events or sales we alert you about.
  • We are not responsible for third-party platforms, including their prices, fees, availability, sold-out status, delivery, or conduct.
  • Sale dates, times, prices, and availability come from public sources and may be inaccurate or change without notice. Always verify details directly with the official vendor before relying on them.

User Responsibilities

Acceptable Use

You agree NOT to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or viruses
  • Attempt to hack, disrupt, or reverse engineer the Service
  • Scrape, harvest, or bulk-extract data from the Service
  • Use bots or automated means to create accounts or generate alerts
  • Resell, redistribute, or commercially exploit our alerts or data without authorization
  • Impersonate others or provide false information
  • Harass, abuse, or harm others

Content and Data

  • You retain ownership of the information you provide (such as the artists you follow).
  • By using the Service, you grant us a limited license to use that information to operate and improve Presto.
  • We may use anonymized, aggregated data for analytics and product improvement.

Intellectual Property

Our Rights

GrowthClan Inc. owns all rights to:

  • The Presto design, code, and functionality
  • The Presto logo, trademarks, and branding
  • Content and copy we create

Event, venue, and artist names and images belong to their respective owners and are used solely to identify events.

License to Use

We grant you a limited, non-exclusive, non-transferable license to use Presto for personal, non-commercial purposes.

You may NOT:

  • Copy, modify, or distribute the Service
  • Create derivative works
  • Remove copyright or proprietary notices
  • Use the Service for competitive purposes

Third-Party Services

Presto relies on third-party providers, including:

  • Public ticketing and event-information sources (such as Ticketmaster)
  • Cloud hosting, database, and authentication providers
  • Email-delivery providers

These services have their own terms and privacy policies. We are not responsible for third-party services.

Disclaimers

"AS IS" Service

Presto is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Uninterrupted, timely, or error-free operation
  • Accuracy, completeness, or reliability of alerts or sale information
  • That you will be able to purchase any ticket

No Guarantee of Tickets

We do not guarantee that an alert will be timely or accurate, that a sale will occur as listed, or that tickets will be available or obtainable. You use the Service at your own discretion and risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not liable for missed purchases, sold-out events, price changes, or any reliance on our alerts or information
  • Our total aggregate liability shall not exceed one hundred U.S. dollars (USD 100)

Indemnification

You agree to indemnify and hold harmless GrowthClan Inc. from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights

Termination

By You

You may stop using Presto at any time and request deletion of your account.

By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive activity
  • Misuse or attempt to disrupt the Service

Upon termination, your access is revoked and your data is handled in accordance with our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective:

  • Immediately upon posting for minor changes
  • 30 days after notice for material changes

Continued use after changes constitutes acceptance.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.

Arbitration Agreement

Any disputes shall be resolved through binding arbitration in San Francisco, California, except for:

  • Small claims court matters
  • Intellectual property disputes

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Exceptions

Nothing prevents either party from seeking injunctive relief in court for intellectual property infringement, data breaches, or violations of confidentiality.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GrowthClan Inc.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver

Our failure to enforce any provision does not waive our right to do so later.

Assignment

You may not assign these Terms. We may assign them to affiliates or acquirers.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
